We don’t store personal information on our servers unless required for the on-going operation of one of our services. Website Visitors

Like most website operators, Sports Marketing USA collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. our purpose in collecting non-personally identifying information is to better understand how our visitors use its website. From time to time, Sports Marketing USA may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website. Sports Marketing USA also collects potentially personally-identifying information like Internet Protocol (IP) addresses for users.

If you are a registered user of a Sports Marketing USA website and have supplied your email address, Sports Marketing USA may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Sports Marketing USA and our products. Sports Marketing USA takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Sports Marketing USA uses cookies to help Sports Marketing USA identify and track visitors, their usage of Sports Marketing USA website, and their website access preferences. If Sports Marketing USA, or substantially all of its assets, were acquired, or in the unlikely event that Sports Marketing USA goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Sports Marketing USA may continue to use your personal information as set forth in this policy.

Privacy Policy Changes

Although most changes are likely to be minor, Sports Marketing USA may change its Privacy Policy from time to time, and in our sole discretion. Sports Marketing USA encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

Terms & Conditions

Payment for Reservations

A 50% payment is due at the time of reservation. Payment in full is due 60 or 90 days prior to departure depending on the trip.

Price Guarantee

Spring Training USA / Sports Marketing USA (SMUSA) guarantees the package price only when paid in full at the time of booking.

Reservation Changes

Any changes made to the itinerary after it is paid in full will be charged a $49.00 change fee.

Cancellation and Refund Policy

Cancellation and refund policies vary, with penalties increasing as the departure date approaches.

If a cancellation occurs, SMUSA will assess the following penalties:
Cancellations made 120 or more days prior to departure = $100.00 per person
Cancellations made 60-119 days prior to departure = 25% of total package price
Cancellations made 30-59 days prior to departure = 50% of total package price
Cancellations made 29 or fewer days prior to departure is non-refundable

London Cancellation and Refund Policy: 
If a cancellation occurs, SMUSA will assess the following penalties:
Cancellations made 120 or more days prior to departure = 25% of total package price
Cancellations made 60-119 days prior to departure = 50% of total package price
Cancellations made 59 or fewer days prior to departure is non-refundable

COVID-19 terms: The terms and conditions of your ticket have been updated to address circumstances related to COVID-19, read them here by clicking on the logo of the home team(s) for the game(s) you are attending.

By clicking the Pay Now button, you agree to accept all Terms and Conditions applicable to your travel package purchase including the updated terms. Further, due to the COVID-19 pandemic, scheduling may be impacted and games may be cancelled, rescheduled or postponed. Upon completing your purchase by selecting Pay Now you acknowledge and agree that your credit card will be charged.

Travel Insurance

Spring Training USA / Sports Marketing USA (SMUSA) does not offer travel insurance. Travelers are advised that travel insurance is available covering lost or damaged baggage, medical needs, trip cancellation, and certain travel-related accidents. SMUSA strongly recommends the purchase of travel insurance from a licensed insurance company to cover losses due to illness or other unforeseen circumstances that prevent or delay your trip.

Physical Mobility Limitations

Any physical mobility limitations that require special attention or treatment must be reported in writing when the reservation is requested so that appropriate arrangements can be made.

Airline Tickets & Baggage Fees

The majority of SMUSA packages do not include airline tickets. Please check your itinerary carefully. Fees for checked bags vary by airline. Please check with your carrier for the most up-to-date information, limits and fees. Flight schedules are subject to change without notice.

Travel Documents and Merchandise

Your travel documents and merchandise will arrive in two separate shipments approximately 10 days prior to departure. If you reside outside the United States, your travel documents and game tickets will be shipped directly to the hotel. We cannot guarantee that guests who make their reservation within 60 days of departure will receive their merchandise prior to the start of their vacation.

Photo Release

The purchaser of a SMUSA travel package grants unrestricted right and license to use the purchaser's likeness of any live or recorded video and photograph taken in connection with the event being attended or otherwise to the participating clubs, league, entities affiliated with the league or participating clubs, and their respective agents.

Hotel Policy

Requests for specific room types, including smoking, non-smoking, or specific bedding are subject to availability and cannot be guaranteed. Hotels generally require a credit card or cash deposit upon check-in to cover incidental hotel charges. Participants are individually responsible for all incidental charges. All incidental charges are to be paid directly to the hotel by the participant upon check-out.

Rental Car

Your rental car includes all taxes, fees and surcharges. These charges often exceed 30% of the base rental rate. Gas, insurance, drop charges, and overtime costs are not included and are payable by participants directly to rental car company. Driver must be 25, have a valid driver’s license and a major credit card. Debit cards with a VISA or Mastercard logo are accepted however the card must have available funds of $200.00 to cover any incidental charges in order to secure the rental. Additional driver fee may apply.

Responsibility

The responsibility of Spring Training USA/Sports Marketing USA (SMUSA ) is limited. SMUSA acts as agent for supplier principals, such as airlines, hotels, and car companies, who furnish lodging, transportation, and other services, and who are identified on SMUSA brochures, web site, and other promotional materials, itineraries, and travel documents. SMUSA further shall not be liable for any loss, injury, damage, or delay to any person, property (including baggage) or otherwise in connection with any accommodations, transportation or other services provided by such principles. You agree that SMUSA is not responsible for any potential risks and or hazards associated with travel to destinations listed in the brochure or on the website. SMUSA further shall not be liable for any damages to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, illness, local laws, weather, cancellation of baseball games, strikes, thefts, pilferage, defaults, additional state or local taxes assessed once travel commences, or cancellation of, or delays of, or changes in itineraries or schedules. SMUSA reserves the right to withdraw, at any time, any package or accommodations represented in its promotional materials, and to substitute hotels, or alter the itinerary as it may deem necessary. No refund for any unused portion of the travel package can be made. The passenger contract in use by the airlines concerned shall constitute the sole contract between the airlines and the purchaser of these travel packages.

Limitation of Liability

Under no circumstances, including but not limited to, negligence, shall we, any MLB entity, and/or our providers or distributors, be liable for any damages to or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing on the site, or your downloading of any materials, data, text, images, video, audio, or other information from the site. In no event shall we, any MLB entity, and/or our providers or distributors, be liable for any injury, loss, claim, damage, or any special punitive, indirect, incidental, or consequential damages of any kind (including, but not limited to, lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, that arise out of or are in any way connected with the use, or the inability to use, the site or the services or materials on the site, even if advised of the possibility of such damages. In no event shall our aggregate liability, or that of our providers or distributors, exceed the total charges set forth in the itinerary giving rise to any such liability. Any claim or cause of action arising from, or relating to, your access and use of, or purchase of products and/or services from the site, must be brought within one (1) year from the date on which such claim or action arose or accrued or purchase was complete. Applicable law may not allow the limitation or exclusion of liability of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Your use of the site shall be at your own risk. We are acting as an intermediary or as an agent for providers of travel-related products and/or services by promoting, selling or accepting reservations or bookings for such products and/or services (such as air and ground transportation, hotel accommodations, meals, tours, travel insurance, etc.)

Notice

Unless otherwise provided herein, notices given by SMUSA to you will be given by e-mail or by conventional mail. Notices will be sent to the e-mail address or mailing address you provide to SMUSA as part of the registration process, or to updated addresses which you provide to SMUSA via notice consistent with this paragraph. Notices given by you to SMUSA must be given by e-mail to web@www.sportsmarketingusa.com or such updated address and number as SMUSA may provide you consistently with this notice provision. Notwithstanding anything herein to the contrary, it is your sole responsibility to update your address for notices hereunder, and notice sent to the e-mail or conventional mailing address last provided by you to SMUSA shall be valid and binding on you regardless of whether such address has been changed, canceled, has expired, has been terminated, or otherwise becomes inoperative. This Agreement shall be governed by and construed in accordance with the laws of the State of California notwithstanding any conflict of laws provisions. You irrevocably and unconditionally: (i) consent to submit to the exclusive jurisdiction of the state and federal courts of the State of California (the “California Courts”) for any litigation or controversy arising out of or relating to this Agreement, (ii) agree not to commence any litigation arising out of or relating to this Agreement except in the California Courts and (iii) agree not to plead or claim that such litigation brought therein has been brought in an inconvenient forum. If any provision(s) of this Agreement is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. Any failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing. The section titles in this Agreement are solely used for the convenience of the parties and have no legal or contractual significance. This Agreement may be assigned in whole or in part by SMUSA, the Company. This Agreement may not be assigned in any manner by you without the express, prior written permission of SMUSA, the Company.
The receipt by SMUSA of your payment signifies that you have read and agree to these conditions.
